1. Who you're dealing with
These terms govern purchases and bookings from Jacara Meadows, a sole proprietorship established July 12, 2022 and operating from Marietta, Georgia 30064, United States ("Jacara," "we," "she"). The business offers three things:
- Baked goods — pastries, cakes, and other non-potentially-hazardous foods made to order in a home kitchen under Georgia's Cottage Food Rules (see the Cottage Food Disclosures);
- Event service — serving, setup, warming/holding, and teardown of food prepared elsewhere (see the Catering Service Scope);
- Tech services — websites, small-business tools, and technology help.
By placing an order or booking, you agree to these terms.
2. Orders, quotes, and payment
- Every order or booking is confirmed in writing (email or text) with the items or scope, price, and date before payment is requested. The written confirmation is the order of record.
- Prices shown on this site are samples; the price in your written confirmation controls. All prices are in U.S. dollars (USD), plus any applicable Georgia sales tax.
- Payment is accepted by PayPal invoice, major cards via PayPal, or cash at pickup. Card and PayPal statement charges appear as J BAKERY.
- Custom orders and event bookings may require a deposit stated in the confirmation.
- Online orders placed through the order page are paid via PayPal's secure checkout and confirmed by your PayPal receipt; Jacara then confirms the exact pickup window in writing within one business day. Online orders are subject to the same lead times, refund terms, and cottage-food rules as any other order.
3. Baked goods
- Products are perishable and intended for prompt consumption. Storage guidance is provided with each order.
- Every package is labeled with ingredients and allergen information as required by Georgia's Cottage Food Rules. The kitchen routinely handles wheat, eggs, milk, butter, soy, peanuts, and tree nuts — tell Jacara about allergies at your table when ordering, and read the label before serving.
- Products are sold directly to consumers for personal use and may not be resold (Ga. Comp. R. & Regs. r. 40-7-19-.05 prohibits wholesale or resale of cottage food products).
4. Event service
Event bookings are service-only: Jacara serves, sets up, warms, holds, and tears down food that you or your chosen licensed kitchen or caterer prepared. She does not cook or produce catering food, and responsibility for the safety and quality of food she did not bake remains with whoever prepared it. The full scope — including what she will and won't do on site — is in the Catering Service Scope, which is part of these terms for event bookings.
5. Tech services
- Tech work begins after a written quote is accepted. Changes in scope are quoted in writing before extra work happens.
- Unless the quote says otherwise, you own the finished deliverables once the final invoice is paid; Jacara may keep and reuse general know-how and non-client-specific code.
- Third-party costs (domains, hosting, software licenses) are yours and are billed at cost or registered in your name directly.
6. Cancellations and refunds
Cancellations, rescheduling, and quality concerns are handled under the Refund & Cancellation Policy, which is part of these terms. Pickup, delivery range, and lead times are in the Pickup & Delivery Policy.
7. Liability
To the fullest extent Georgia law allows, Jacara's total liability for any order or booking is limited to the amount you paid for it, and she is not liable for indirect or consequential damages. Nothing in these terms limits liability that cannot be limited under applicable law, and nothing shifts to Jacara any responsibility for food she did not prepare.
8. Governing law
These terms are governed by the laws of the State of Georgia. Any dispute will be resolved in the state courts of Cobb County, Georgia, after both sides first make a good-faith attempt to work it out directly — which, with Jacara, usually works.
9. Changes and contact
These terms may be updated from time to time; the version posted here applies to new orders from its effective date. Questions: see the contact page.
